Virginia man accused of not paying rent

Late 04

MOOREFIELD — A lawyer is suing Andrew R. Hammaker, a resident of Chesapeake, Virginia, citing alleged abandonment.

William H. Judy III, d/b/a Judy and Judy Real Estate, filed a complaint on July 12 in Hardy Circuit Court against Hammaker, alleging that the defendant failed to comply with the terms of their lease agreement.

According to the complaint, the plaintiff alleges that he suffered monetary damages for not receiving payment for the lease of commercial property in the amount of $750 per month and an apartment for $550 per month. The plaintiff holds Andrew R. Hammaker responsible because the defendant allegedly abandoned the property, leaving a Harley-Davidson motorcycle behind that needs to be sold.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $2,500, an order allowing him to sell the motorcycle, costs and fees and such other relief as the court deems just. The plaintiff, of Judy & Judy in Moorefield, is representing himself.
