Motorist says carelessness caused injuries

PRINCETON — A motorist is suing Bluefield resident Zachary Keith Brewster and his insurer, State Farm Mutual Automobile Insurance Company, alleging insufficient measures were taken to prevent injuries.

Calvin Bailey Sr. of Big Sandy filed a complaint on July 12 in Mercer Circuit Court against the defendants, alleging that Brewster operated his vehicle in a careless and reckless manner.

According to the complaint, the plaintiff alleges that on Aug. 19, while he was lawfully operating his vehicle on Oakvale Road in Princeton, Brewster negligently operated his vehicle and struck the rear of the plaintiff's vehicle, causing him to suffer damages and injuries, resulting in physical and mental pain and medical expenses. The plaintiff holds Brewster and State Farm Mutual Automobile Insurance Company responsible because Brewster allegedly followed the plaintiff's vehicle too closely and failed to keep a proper lookout.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, pre- and post-judgment interest, attorney's fees and such other relief that the court may deem proper. He is represented by Harold B. Wolfe III of Akers Law Office in Princeton.
