Father sues city and law enforcement officers

WHEELING — A father is suing Garrett Pugh, Doug Howell and the City of Wheeling, a municipal corporation and law enforcement officers, alleging assault and battery, intentional infliction of emotional distress, negligent retention and hiring, negligent training and supervision, deliberate indifference and civil conspiracy.

Othello Thomas Byndon filed a complaint on June 22 in Ohio Circuit Court against the defendants, alleging that they unlawfully deprived him of his rights under the color of the state law.

According to the complaint, the plaintiff alleges that on June 23, 2014, he was detained and incarcerated for 10 days, which caused him to lose time to be with his children and caused him to expend money for posting bail. He says he also was caused to suffer physical pain and loss of property, embarrassment, humiliation and inconvenience. The plaintiff holds the defendants responsible because they allegedly acted intentionally with malice, made false and misleading accusations, effectuated a warrantless arrest, unlawfully arrested and battered him and unlawfully seized his personal property.

The plaintiff requests a trial by jury and seeks judgment against defendants jointly and severally for all losses and damages, attorneys' fees, costs of this action and such other legal relief to which he may be entitled. He is represented by Donald J. Tennant of Tennant Law Offices in Wheeling and Martin P. Sheehan of Sheehan and Nugent PLLC in Wheeling.
