Woman sues financing companies, ex-husband

BECKLEY — A woman is suing Primerica Financial Services Inc., Princor Financial Services Corp. and Mark Robert Lively, financing companies and her former husband, citing alleged failure to effectuate equitable distribution.

Opal Rilla Lively (now Morgan) filed a complaint on June 21 in Raleigh Circuit Court against the defendants, alleging that they failed to comply with a document listed as the second amended supplemental final divorce decree.

According to the complaint, the plaintiff alleges that she was caused to suffer significant loss of funds and damages for loss of use and possession of retirement funds, and was unsuccessful in causing the remaining accounts to be transferred to her private account. The plaintiff holds the defendants responsible for allegedly failing to effectuate an equitable distribution of the retirement assets, and she alleges that Mark Lively removed some of the funds from the retirement assets.

The plaintiff requests a trial by jury and seeks an order for the defendants to produce statements regarding the subject assets, an order for the defendants to effect equitable distribution, judgment for attorney's fees and costs, pre- and post-judgment interest and such other relief in her favor. She is represented by Anthony Veneri of Veneri Law Offices in Princeton.
