Property owner files suit for allegedly unpaid rent

MOOREFIELD – The owner of a property alleges several companies that leased it have not paid the rental fees.

William H. Judy III, doing business as Judy and Judy Real Estate, filed a complaint on July 12 in Hardy Circuit Court against EMPC-Biomass of Moorefield LLC, EMPC-Bio-Energy Group LLC, EMPC-Biomass of Altoona LLC et al alleging that they breached the lease and guaranty agreement.

According to the complaint, the plaintiff alleges that between Dec. 1, 2013, and Feb. 1, 2015, he did not receive rent payment for the commercial lease of a property and the apartment in the sum amount of $19,500 from the defendants. Furthermore, he did not receive payments upon the guaranty agreement in the amount of $23,522.20. The plaintiff holds EMPC-Biomass of Moorefield LLC, EMPC-Bio-Energy Group LLC, EMPC-Biomass of Altoona LLC et al responsible because the defendants allegedly abandoned the property, leaving some property that needs to be sold.

The plaintiff requests a trial by jury and seeks judgment against defendants in the amount of $23,522.20, an order allowing him to sell the property that defendants left behind, court costs and such other relief as the court deems just. He is representing himself.
