Suit filed against health care providers over prescriptions allegedly given to woman

BECKLEY – A woman has filed suit alleging that health care providers departed from acceptable medical standards by prescribing medications that caused her daughter's death.

Barbara Dean, as administratrix of the estate of M.M., filed a complaint on July 28 in Raleigh Circuit Court against Dr. J. Jorge Gordinho, Responsible Pain & Aesthetic Management PLLC, Alleghany Medical Services PC and Dr. Yasar Aksoy alleging violation of the West Virginia Wrongful Death Act.

According to the complaint, the plaintiff alleges that her decedent died on Oct. 2, 2014, and the cause of death was determined to be a combined oxymorphone, hydrocodone and diazepam intoxication. The plaintiff holds the defendants responsible because the defendant Gordinho allegedly prescribed a massive amount of oxycodone to plaintiff's decedent, who had a history of opioid addiction, and defendant Aksoy prescribed hydrocodone without conferring with previous providers.

The plaintiff requests a trial by jury and seeks judgment in an amount within the jurisdiction of the court together with their costs expended. She is represented by James D. McQueen of McQueen Davis PLLC in Huntington and Christopher J. Heavens of Heavens Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge John A. Hutchison.
