WEST UNION — A man is suing former employer Rush Wellsite Services LLC, citing alleged discrimination and unlawful termination.
Jonah Burros filed a complaint on July 21 in the Doddridge Circuit Court, alleging that Rush Wellsite Services LLC violated the West Virginia Workers' Compensation Act.
According to the complaint, the plaintiff alleges that on Feb. 10, 2015, he sustained injuries while working for the defendant at a wellsite in Doddridge County and received temporary total disability benefits in connection with a workers' compensation claim. He has since been released to return to work but has not been called back to duty by the defendant, he claims, alleging that he has suffered lost wages and benefits, embarrassment and humiliation. The plaintiff holds Rush Wellsite Services LLC responsible because the defendant allegedly discriminated against him by unlawfully terminating his employment because of his attempt to receive workers' compensation benefits.
The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages, pre-judgment interest, attorney's fees and such other relief as the court may deem just and proper. He is represented by Matthew B. Hansberry of Hansberry Law Office PLLC in Bridgeport.
