Man whose son died alleges harassment by debt collectors

CHARLESTON — A man whose son died is suing Weltman, Weinberg & Reis, a debt collector, citing alleged intentional infliction of emotional distress and violation of telephone harassment statutes.

Michael Nunn filed a complaint on June 29 in Kanawha Circuit Court against Weltman, Weinberg & Reis, alleging that the debt collector violated the West Virginia Consumer Credit and Protection Act.

According to the complaint, the plaintiff alleges that he received collection calls attempting to collect a student loan owed by his deceased son, Chris Nunn. As a result, he has suffered damages that caused him to be annoyed, inconvenienced, harassed, bothered, and distressed, the suit alleges. The plaintiff holds Weltman, Weinberg & Reis responsible because the defendant allegedly refused to stop calling him even after his lawyer informed them that he is being represented by counsel and that the defendant allegedly has no right to collect the alleged debt and engaged in oppressive and abusive collection practices.

The plaintiff requests a trial by jury and seeks compensation for all damages, attorneys' fees, costs and such other relief as the court deems just and proper. He is represented by Benjamin Sheridan and Daniel K. Armstrong of Klein & Sheridan LC in Hurricane.
