NEW CUMBERLAND — A woman is suing Hiler Buffalo LLC, a commercial building operator, alleging insufficient measures were taken to prevent injuries.
Deborah L. Harper filed a complaint on July 27 in Hancock Circuit Court against Hiler Buffalo LLC, alleging that the commercial building operator failed to comply with the applicable laws and regulations of West Virginia.
According to the complaint, the plaintiff alleges that on July 29, 2014, she was walking up the interior steps at the Chester Post Office, a leasee in the defendant's building, when the stairway railing gave way, causing her to be flung through a glass wall. She sustained injuries to her head, neck, shoulders, hand, foot and ankle and also suffered excessive bleeding, great pain, medical expenses and mental anguish, she claims. The plaintiff holds Hiler Buffalo LLC responsible because the defendant allegedly failed to maintain its premises in a safe and good condition and failed to exercise the degree of care required under the circumstances.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of the jurisdiction of the court. She is represented by James G. Connolly of Law Offices of James G. Connolly LC in Weirton.
