Woman alleges failure to provide reasonable accommodation

WINFIELD — A winder operator is suing Diamond Electric Manufacturing Corporation, a former employer, citing alleged failure to provide reasonable accommodation.

Marthe Fisch filed a complaint on Aug. 2 in Putnam Circuit Court against Diamond Electric Manufacturing Corporation, alleging that the former employer violated the West Virginia Human Rights Act.

According to the complaint, the plaintiff alleges that she suffered from unnecessary aggravation and emotional distress for fear of the consequence of decreased productivity as well as pain and suffering from working without a chair, She also suffered humiliation and embarrassment from being fired, she alleges. The plaintiff holds Diamond Electric Manufacturing Corporation responsible because the defendant allegedly refused to acknowledge her disability and refused to provide her with reasonable accommodations and discriminated against her in terms of tenure and privileges of employment.

The plaintiff requests a trial by jury and seeks judgment againstthe  defendant for all damages, attorneys' fees, court costs and such other relief deemed to be just and proper. She is represented by David M. Adkins and Karin L. Coombe of The Adkins Law Firm PLLC in Hurricane.
