Pair claim debt collection attempts are morass of confusion

POINT PLEASANT — Two consumers are suing MRS BPO LLC d/b/a MRS Associates, a debt collection agency, alleging unfair and unconscionable debt collection.

Charles Burns and Jackie Burns filed a complaint on Aug. 4 in Mason Circuit Court against MRS BPO LLC d/b/a MRS Associates, alleging that the debt collection agency violated West Virginia Code.

According to the complaint, the plaintiffs allege that they suffered economic losses, stress, worry, annoyance and inconvenience from collection attempts for a total of 17 different accounts, in which they purport that there aren't clear answers regarding what is owed, why it is owed and how payments have been applied.

The plaintiffs hold the defendant responsible for allegedly ignoring their letters and failing to validate the debts, failing to provide loan information and failing to provide account statements.

The plaintiffs request a trial by jury and seek compensation for all damages, plus attorney's fees and costs and such other relief as the court deems just and equitable. They are represented by Sara Bird and Lydia C. Milnes of Mountain State Justice Inc. in Clarksburg.
