Master machinist alleges age discrimination

BECKLEY — A master machinist is suing Phillips Machine Services Inc., a mining machine manufacturer, citing alleged age discrimination and intentional infliction of emotional distress.

Don Goins filed a complaint on Aug. 4, in the Raleigh Circuit Court against Phillips Machine Services Inc. alleging that the mining machine manufacturer violated the West Virginia Human Rights Act.

According to the complaint, the plaintiff alleges that as a result of defendant's actions, he has suffered and will continue to suffer, lost wages and benefits, indignity, embarrassment, humiliation emotional distress and annoyance. The plaintiff holds Phillips Machine Services Inc. responsible because the defendant allegedly engaged in a pattern of discriminatory employment practices, terminated his employment on March 27, 2015, failed to transfer, accommodate, rehire and reinstate him due to his age.

The plaintiff requests a trial by jury and seeks compensation for all damages, pre and post judgment interest, attorney's fees and costs and such other relief as the court deems just and equitable.
