WHEELING — A former employee is suing Stratford Springs Enterprises LLC, alleging failure to accommodate and wrongful termination.
James Waitts filed a complaint on Aug. 18 in Ohio Circuit Court against Stratford Springs Enterprises LLC alleging that the former employer violated West Virginia public policy.
According to the complaint, the plaintiff alleges that between 2014 and June 1, 2016, he missed four days of work due to illness. On June 3, he was treated at Wheeling Hospital, and on June 8, his next scheduled day to work, he was advised to call the office before coming in, he alleges. When he called, the defendant advised him that he was not fit to work and he was being terminated, he claims, adding that this caused him to suffer lost wages, emotional distress, embarrassment and inconvenience. The plaintiff holds Stratford Springs Enterprises LLC responsible because the defendant allegedly unlawfully discriminated against him, failed to reasonably accommodate him and acted with criminal indifference of its civil obligation.
The plaintiff seeks judgment against the defendant for all damages in an amount to be determined at trial. He is represented by Frank X. Duff and Sandra K. Law of Schrader Byrd & Companion PLLC in Wheeling.
