PRINCETON — A married couple's lawsuit against vehicle owners Astrazeneca LP and Wheels LT and vehicle driver Everett Lee Fraley alleges insufficient measures were taken to prevent injuries.
Nora R. Austin and Melvin M. Austin filed a complaint on Aug. 22 in Mercer Circuit Court against the corporate defendants, alleging that they failed to properly train their employee, defendant Fraley.
According to the complaint, the plaintiffs allege that on March 31, 2015, Nora R. Austin was a passenger in an Oldsmobile owned and operated by Wanda M. Brewer, traveling south on Ingleside Road in Princeton, when Fraley, who was driving a Ford Fusion owned by defendants Astrazeneca LP and Wheels LT, drove in such a manner as to allow it to collide with the vehicle being driven by Brewer. As a result, Nora Austin suffered serious injuries and incurred medical expenses in excess of $18,500, the suit alleges. The plaintiffs hold the defendants responsible because Fraley allegedly failed to maintain proper control of the vehicle and failed to avoid the accident.
The plaintiffs request a trial by jury and seek judgment against the defendants jointly and severally in such an amount as is justified by evidence. They are represented by Kevin B. Burgess, Christopher B. Frost and Steven Broadwater, Jr. of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.
