BECKLEY — A woman is suing another motorist, alleging that insufficient measures were taken to prevent injuries.
Mary P. Stalans filed a complaint on Aug. 23 in Raleigh Circuit Court against Ethan Bryant alleging that the defendant violated the requirements of the West Virginia Code by failing to control his speed to avoid a collision.
According to the complaint, the plaintiff alleges that on Oct. 31, 2014, she was operating a 1997 Jeep Cherokee traveling north on U.S. Route 19, waiting for oncoming traffic to pass so she could make a left turn, when suddenly her vehicle was rear-ended by the defendant's vehicle, causing her to sustain injuries, pain and suffering, lost wages, annoyance, inconvenience and medical expenses. The plaintiff holds Bryant responsible because the defendant allegedly followed her too closely, failed to slow down and and struck the rear of her vehicle.
The plaintiff requests a trial by jury and seeks compensatory damages in an amount to be determined at trial, punitive damages, pre- and post-judgment interest, attorneys' fees, costs, expenses and such other relief.
