Northstar Location Services, Ally Financial accused of attempting to collect time-barred debt

BECKLEY — A woman has filed a class-action lawsuit against two debt collectors, alleging violation of the state code.

Lisa Bennett is suing Northstar Location Services LLC and Ally Financial Inc., alleging unjust enrichment and unfair and unconscionable collection practices.

Bennett filed a complaint on Aug. 26 in Raleigh Circuit Court against the defendants, alleging that they violated the West Virginia Code.

According to the complaint, the plaintiff alleges that she defaulted upon her retail installment sales contract, more than four years prior to a May 6 collection letter, and that the alleged attempt to collect a time-barred debt caused her to be damaged. The plaintiff holds Northstar Location Services LLC and Ally Financial Inc. responsible because the defendants allegedly fraudulent attempted to collect a time-barred debt and failed to give her the notice of time-barred debt.

The plaintiff requests a trial by jury and seeks compensation for all damages, restitution of payments, debt cancellation relief, costs of litigation, attorneys' fees and such other relief.
