Huntington passenger blames bus operator, driver for injuries

HUNTINGTON — A passenger is suing a bus operator and driver, alleging their negligence led to the plaintiff sustaining injuries. 

Mary M. McCallister filed a lawsuit Aug. 19 in Cabell Circuit Court against Tri-State Transit Authority, Randy L. Mullins and John Doe, alleging negligence in breaching their duty to protect passengers.

According to the complaint, on Aug. 1, 2014, McCallister was attempting to exit the bus at a bus stop at the WalMart parking lot in Huntington when her foot became stuck under the wheelchair ramp. The suit says this caused McCallister to fall forward and sustain disabling injuries that led to pain and suffering, mental anguish, lost wages and benefits and medical expenses. 

The plaintiff alleges Mullins negligently raised the wheelchair ramp without looking for passengers attempting to exit.

McCallister seeks trial by jury, judgment against defendants, jointly and severally, for compensatory damages, attorney fees and costs, pre- and post-judgment interest and all other general relief. She is represented by attorney Chad Hatcher of Hatcher Law Office in Huntington.
