Woman sues Raleigh Heart Clinic, physician for blood-borne illnesses

BECKLEY – Another lawsuit has been filed against Raleigh Heart Clinic due to the increased risk of exposure to blood-borne illnesses.

Dr. Thair Barghouthi was also named as a defendant in the suit.

T.S., a 31-year-old female who resides in Greenbrier County, presented to Barghouthi at Raleigh Heart Clinic between March 1, 2012, and March 27, 2015, according to a complaint filed in Raleigh Circuit Court.

T.S. presented to Raleigh Heart Clinic for numerous evaluations, including a cardiac stress test on jan. 14, 2014.

Upon information and belief, Barghouthi used the same syringe and vial to administer injections to T.S. and other patients and on June 21, she was diagnosed with Hepatitis C, according to the suit.

On March 11, a letter was sent to Bargouthi’s patients by the West Virginia Department of Health and Human Resources advising them of an ongoing investigation linking several cases of viral Hepatitis with cardiac stress tests performed at the clinic, according to the suit.

T.S. claims the defendants owed a duty of care to her to comply with the applicable standard of care and that they deviated from the standard of care expected of reasonably prudent healthcare providers in the same or similar circumstances.

The negligent, intentional, willful, wanton and reckless actions and inactions of Barghouthi and Raleigh caused T.S. harm, according to the suit.

T.S. is seeking compensatory and punitive damages. She is being represented by Scott S. Segal and C. Edward Amos II of the Segal Law Firm.

There have been multiple lawsuits filed against the clinic and Barghouthi due to exposure to blood-borne pathogens at the clinic.
