Home buyer accuses seller, lender, debt collector of illegal foreclosure

GRAFTON — A Taylor County home buyer is suing a seller, lender and debt collector, alleging they illegally foreclosed his property. 

Matthew Freeze filed a lawsuit Sept. 6 in Taylor Circuit Court against CMH Homes Inc., doing business as Clayton Homes Buckhannon WV, Vanderbilt Mortgage and Finance Inc. and Marc B. Lazenby, alleging unlawful debt collection and unreasonable disposition.

According to the complaint, Freeze has suffered financial injury for the loss of his mobile home and land, loss of funds, anxiety, fear and worry. The plaintiff alleges the the defendants changed the terms of his monthly payment that far exceeded what he was told, engaged in abusive conduct, repeatedly misrepresented the status of Freeze's account and foreclosed his home without notice.

Freeze seeks trial by jury, compensation for actual, incidental and consequential damages, plus penalties, attorney fees, court costs and all other relief deemed equitable and just. He is represented by attorneys Jennifer S. Wagner and Colten Fleu of Mountain State Justice Inc. in Clarksburg.
