Customer alleges Kroger's negligence caused her to suffer injuries at store

BECKLEY — A Wyoming County woman is suing Kroger, alleging the defendant's negligence caused the plaintiff to sustain injuries. 

Tabitha Little filed a lawsuit Sept. 7 in Raleigh Circuit Court against Kroger Group Cooperative Inc., alleging negligence in failing to inspect its premises.

According to the complaint, on June 3, 2015, Little was at the Kroger store in Beckley when she slipped and fell due to liquid on the floor. The suit says the fall caused Little to sustain serious injuries that resulted in pain and suffering, emotional distress, medical expenses and loss of earning capacity. 

The plaintiff alleges Kroger failed to make safe the property and failed to warn Little of the dangerous condition.

Little seeks trial by jury, compensation for all damages, all recoverable costs, pre- and post-judgment interest and any other compensation deemed appropriate. She is represented by attorney Timothy P. Lupardus of Lupardus Law Office in Pineville.
