Appalachian Highlands Ventures alleged to owe fees to condo owners association

MARLINTON – A condominium owners association alleges it is owed approximately $40,000.

Soaring Eagle Lodge Association Inc. and Soaring Eagle Lodge Master Association Inc. filed a lawsuit Sept. 2 in Pocahontas Circuit Court against Appalachian Highlands Ventures LLC, Thomas W. Greene Jr. and William A. Treadway, alleging breach of agreement.

According to the complaint, the plaintiffs allege they have suffered financial damages for not collecting payment for the defendants' general operating reserve and propane fee in the sum of of $39,830.77.

The plaintiffs allege the defendants have failed to make payments for all dues and assessments properly levied against their properties.

The plaintiffs seek trial by jury, judgment of $57,751.02, plus penalties, costs of recordation, attorney fees, pre- and post-judgment interest and all other relief. They are represented by attorney Robert C. Chenoweth of Busch, Zurbuch & Thompson PLLC in Elkins. The case has been assigned to Circuit Judge Robert E. Richardson.
