Wheeling woman blames municipality for injuries

WHEELING — A Wheeling woman is suing the Wheeling Park Commission and an individual, alleging insufficient measures were taken to prevent injuries retaliation, and wrongful termination.

Ashley Sutton filed a lawsuit Sept. 15 in Ohio Circuit Court against the Wheeling Park Commission and Kevin O'Brien, alleging O'Brien negligently maintained his residence in a dangerous condition.

According to the complaint, on Sept. 19, 2014, she was lawfully present at O'Brien's residence, 5 Stratford Road, Wheeling, acting in a careful manner when she slipped and fell, causing her to sustain severe injuries that are permanent and lasting in nature. 

Sutton alleges she has been caused to sustain mental and emotional harm, medical expenses and loss of earning capacity due to the fall. 

The plaintiff alleges O'Brien negligently failed to take proper measures to remediate the dangerous condition and that the Wheeling Park Commission assigned her to heavy physical labor and wrongfully discharged her.

Sutton seeks trial by jury, judgment in excess of the minimum jurisdictional limits of the court, plus interest, attorney fees, court costs and all other relief. She is represented by attorneys Ronald W. Zavolta and Jordan M. Laird of Zavolta Law Office in Wheeling.
