Restaurant operators accuse insurance company of failing to provide coverage

CLARKSBURG — Clarksburg restaurant operators are suing an insurer and a Marshall County man, alleging failure to provide insurance coverage.

Grand China Buffet & Grill Inc. and Qi Feng Chen filed a lawsuit in U.S. District Court for the Northern District of West Virginia, Clarksburg Division against State Auto Property and Casualty Co. and Scott Ullom of Marshall County, alleging they neglected to perform the conditions under the insurance policy.

According to the complaint, as a result of State Auto's withdrawal of insurance, the plaintiffs have suffered financial injury from defending themselves on a complaint filed by Ullom, a hearing-impaired man who brought a dog into the Grand China Buffet & Grill. 

The plaintiffs allege State Auto withdrew from its defense obligations in an untimely manner and avoided its coverage obligations under the insurance policy issued to the plaintiffs.

The plaintiffs seek trial by jury, judgment against State Auto in an amount that will fully compensate them, punitive damages of up to $75,000 and all other relief the court deems just. They are represented by attorneys Daniel C. Cooper and Jamison H. Cooper of Cooper Law Offices PC in Bridgeport.
