Consumer accuses Transworld Systems of invading privacy with phone calls

FAYETTEVILLE – A consumer alleges a debt collector invaded her privacy with its phone calls.

Misty C. Hicks filed a complaint on Sept. 20 in Fayette Circuit Court against Transworld Systems Inc. alleging that the debt collector violated the West Virginia Consumer Credit and Collection Protection Act and other counts.

According to the complaint, the plaintiff alleges that after she became in arrears for an alleged debt, she began receiving collection calls and written communications from the defendant attempting to collect the alleged debt in July. She alleges the defendant's actions caused her to be annoyed, inconvenienced, harassed and abused.

The plaintiff holds Transworld Systems Inc. responsible because the defendant allegedly engaged in oppressive or abusive collection practices using an electronic communication device and continued to contact her even after being requested to desist contacting her.

The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages, costs of litigation, and for such other relief. She is represented by Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville. The case has been assigned to Circuit Judge Paul M. Blake Jr.
