CHARLESTON — A Kanawha County woman is suing her former employers, alleging hostile work environment and wrongful termination.
Rachel Runyon filed a lawsuit Sept. 21 in Kanawha Circuit Court against Mountain State Medicine and Rheumatology PLLC, Dr. Phillip Reginald Triplett Jr. and Dr. Leah M. Triplett, alleging violation of the West Virginia Human Rights Act and the West Virginia Wage Payment and Collection Act.
According to the complaint, during Runyon's employment from 200-12 she was subjected to sexual harassment by the defendants' patients. The suit also said she suffered unpaid wages, loss of benefits and emotional distress.
The plaintiff alleges the defendants failed to protect her from being offended, failed to resolve her complaint of patients' harassment, terminated her employment and failed and refused to pay her for 116 hours of accrued and unused paid time off.
Runyon seeks trial by jury, judgment against each defendant for actual damages, punitive damages, reinstatement, attorney fees and court costs, plus all other relief. She is represented by attorney Walt Auvil of The Employment Law Center PLLC in Parkersburg.
