BECKLEY — A Raleigh County woman is suing an automobile manufacturer, alleging breach of implied warranty.
Tammy A. Flumley of Ghent filed a lawsuit Sept. 22 in Raleigh Circuit Court against FCA US LLC, doing business as Sheets Chrysler Jeep Dodge, alleging violation of the Lemon Law.
According to the complaint, on Jan. 23, 2015, Flumley purchased a new 2015 Jeep Patriot from Sheets Chrysler, the manufacturer's authorized dealer, for $29,930. After purchase, the suit says, Flumley experienced repeated non-conformities with the vehicle's warranty, which substantially impaired its use and value. The lawsuit says some of these non-comformities could be life threatening.
The plaintiff alleges FCA US failed to conform the vehicle with its warranties and refused to replace it with a comparable new one.
Flumley seeks trial by jury, revocation of acceptance, a refund of the purchase price, including out-of-pocket expenses, all damages, attorney fees and all other relief. She is represented by attorney Anthony M. Salvatore of Hewitt & Salvatore PLLC in Beckley.
