Bluefield woman blames ex-boyfriend, city for sexual assault

PRINCETON — A Bluefield woman is suing an ex-boyfriend and a local municipality, alleging sexual assault and failure to intervene in the ongoing attack.

Crystal Adkins filed a lawsuit Sept. 23 in Mercer Circuit Court against Tommy Lee Ray Dailey and the city of Bluefield, alleging Dailey violated the West Virginia Rules of Criminal Procedure.

According to the complaint, on Feb. 28, 2015, Adkins was kidnapped, tortured and beaten up for more than eight hours in her Bluefield home by Dailey, her former boyfriend. As a result, the suit says, Adkins suffered great mental anguish, pain, humiliation and degradation.

The plaintiff alleges Dailey sexually assaulted her and Bluefield's police showed deliberate indifference to her personal safety by abandoning any attempt to locate her residence.

Adkins seeks trial by jury and compensatory damages in an amount not to exceed the statutory limits imposed by law. She is represented by attorneys William Flanigan and Ryan Flanigan of Sanders, Austin & Flanigan in Princeton.
