Secretary of labor accuses Elkins business of worker violations

ELKINS — The U.S. secretary of labor is suing an Elkins business, alleging violation of workers compensation acts in failing to pay the minimum wage.

Thomas Perez, U.S. secretary of labor, filed a lawsuit Sept. 27 in U.S. District Court for the Northern District of West Virginia Elkins Division against Randolph County Sheltered Workshop Inc., doing business as Seneca Designs, alleging violation of provisions of the Fair Labor Standards Act.

According to the complaint, Seneca Designs' former and current employees have suffered and continue to suffer monetary damages for not receiving the regular minimum wage rate as required by law. The plaintiff alleges Seneca Designs failed to secure a certificate allowing it to pay its employees less then the minimum wage and continually violated the provisions of the FLSA.

Perez seeks trial by jury, an order finding the defendant liable for unpaid wages and for liquidated damages due its employees, enjoining the defendant from withholding payment of minimum wages due its employees and all other relief. He is represented by attorneys M. Patricia Smith, Oscar L. Hampton, III, Douglas N. White, Francine A. Serafin, and Karen M. Barefield of the U.S. Department of Labor in Arlington, Virginia.
