Rehabilitation counselor accuses state agency of discrimination

CHARLESTON — A Huntington man is suing a state agency, alleging discrimination in failure to uphold Americans with Disabilities Act regulations.

Eugene M. Johnson filed a complaint Oct. 3 in the U.S. District Court for the Southern District of West Virginia against the West Virginia Division of Rehabilitative Services, alleging violation of Title VII of the 1964 Civil Rights Act.

According to the complaint, in July 2015, Johnson was terminated from his employment due to his disabilities, which include attention deficit disorder, dyslexia, migraine headaches and depression.

The suit says prior to his termination as a rehabilitation counselor, Johnson was subjected to discrimination and retaliation. The plaintiff alleges the defendant failed to provide reasonable accommodations, interfered with Johnson's chances of advancement and terminated the funding of his obtaining licensure as a licensed practicing counselor.

Johnson seeks trial by jury and judgment in an amount sufficient to compensate his damages and to deter the defendant from further acts of disability discrimination. He is represented by attorney B. Luke Styer of Huntington.
