Equipment lender alleges contractor owes $28,000

WEBSTER SPRINGS — An equipment company is suing a West Virginia contractor and a guarantor, alleging breach of contract in failing to pay more than $28,000.

Leslie Equipment Company filed a lawsuit Oct. 27 in Webster Circuit Court against Clearwater Contracting Inc. of Cowen, West Virginia, and Michael Chaffin, alleging failure to perform their contractual obligations.

According to the complaint, on Sept. 23, Clearwater rented equipment, purchased parts and received services from Leslie Equipment in the amount of $28,585.10. To date, the suit says, the plaintiff has not received full payment for this amount. 

Leslie Equipment seeks trial by jury, judgment, jointly and severally, of more than $28,585.10, plus interest at the rate of 18 percent per annum, attorney fees and collection costs, plus all other appropriate relief. It is represented by attorney Jason S. Hammond of Bailey & Wyant PLLC in Charleston.
