Oil, gas rights owners accuse well operators of contract breach

PHILIPPI — Two owners of oil and gas rights are suing oil well operators, alleging alleged breach of a lease agreement.

David Booth of Harrison County, West Virginia, and Jody Stewart of Erie County, Ohio, filed a lawsuit Nov. 3 in Barbour County Circuit Court against Statoil USA Onshore Properties Inc., SWN Production Company LLC and Mountain V LLC, alleging failure to comply with the lease.

According to the complaint, Booth and Stewart have not received royalty payments from the defendants for more than 24 months. The plaintiffs allege the defendants have failed to produce and sell oil and gas for the period greater than 24 months and have failed to pay well rental, delay rental and other similar payments to keep the lease in effect since December 2013.

Booth and Stewart seek trial by jury, declaration the lease on all shallow and deep well rights is terminated, prohibiting and barring the defendants from entering the property and all general relief that is fair and equitable. They are represented by attorney Kyle Nuttall of Buckhannon.
