Estate administrator blames nursing home operator for patient's death

LOGAN — An estate administrator is suing a Logan nursing home operator, alleging the defendant's negligence led to the death of a patient. 

Regina McNeely, administrator of the estate of William Harold Gartin filed a complaint on Nov. 15, in the Logan Circuit Court against Trinity Health Care Services of Logan Inc., alleging the defendant breached its duty to provide care and services to Gartin.

According to the complaint, during Gartin's residency at Trinity Health Care between June 27, 2014, and until his death Oct. 1, 2014, he was deprived of his nursing home resident's rights, including the right to be free of abuse, neglect, and mistreatment, the right to receive appropriate treatment and services and the right to receive adequate health care and supportive services. 

The plaintiff alleges the defendant failed to implement appropriate care and measures to monitor Gartin in order to prevent falls from occurring, and failed to properly hire, train and supervise its employees/agents.

McNeely seeks trial by jury, judgment in an amount that will compensate the estate of the decedent for every element of damage, pre- and post-judgment interest, costs of court and all other proper relief. She is represented by attorney Robert B. Kuenzel of Kuenzel Law PLLC in Chapmanville.
