Wheeling motorist accuses insurer of breaching contract

WHEELING — A Wheeling motorist is suing a Pennsylvania insurance company, alleging failure to comply with contractual obligations. 

Robert Wren filed a lawsuit Nov. 16, in the Ohio Circuit Court against Erie Insurance Company, doing business as Erie Insurance of Erie, Pennsylvania, alleging breach of contract. 

According to the complaint, on Jan. 23, 2015, Wren's vehicle was struck by a car operated by Amanda Meeks in Wheeling when she crossed the center line. The suit says the crash caused injuries to Wren and damage to his vehicle. 

The lawsuit states Wren and Erie Insurance accepted Meeks' insurance limit of $50,000 and disputed the extent of such injuries and damages. The plaintiff alleges Erie Insurance has failed to sufficiently compensate Wren for his injuries, damages and losses.

Wren seeks trial by jury, compensatory damages in excess of the minimum jurisdictional limits of the court, attorney fees, interest, court costs and all other just and appropriate relief. He is represented by attorney David A. Jividen of Jividen Law Offices PLLC in Wheeling.
