Insurance beneficiary alleges State Farm breached contract

POINT PLEASANT — A Point Pleasant man is suing State Farm, alleging breach of an insurance contract.

Dustin G.A. Stanley filed a lawsuit Nov. 17 in Mason Circuit Court against State Farm Mutual Automobile Insurance Company, alleging violation of the West Virginia Unfair Trade Practices Act.

According to the complaint, on Nov. 24, 2014, Stanley sustained bodily injuries and damages in a Point Pleasant vehicle crash that are in excess of the available limits covered by State Farm. The lawsuit states Stanley has complied with all conditions for an under-insured claims. 

As a result of State Farm's contract breach, Stanley says he has suffered physical and mental pain and medical expenses. The plaintiff alleges the defendant has failed to offer the available policy limits for the entire insurance contract and failed to pay the benefits due and owing.

Stanley seeks trial by jury, judgment for all damages, attorney fees and court costs, pre-judgment interest and all other appropriate relief. He is represented by attorney Bradley H. Layne of Kayser Layne & Clark PLLC in Point Pleasant.
