Driver files suit for damages after accident with tractor-trailer

RIPLEY – A South Carolina driver alleges he was struck by a tractor-trailer.

John Lee Nicholson filed a complaint on Nov. 18 in the Jackson Circuit Court against Emsud Kurtovic and/or Sara Trans Express Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 18, 2015, Kurtovic caused the semi-tractor owned by Sara Trans Express to struck plaintiff's trailer. The plaintiff alleges he sustained serious injuries resulting pain and suffering, mental anguish and incurred medical bills. The plaintiff holds Kurtovic and/or Sara Trans Express Inc. responsible because defendant Kurtovic allegedly traveled at a speed too fast for the conditions, failed to yield right-of-way, and failed to maintain proper control of his vehicle.

The plaintiff requests a trial by jury and seeks judgment against defendants' jointly and severally in such amount that will fairly and reasonably compensate him for his damages, pre- and post-judgment interest.
