Ohio Co. judge accuses Frontier of unfair debt collection

WHEELING – Ohio Circuit Judge David J. Sims has filed a lawsuit against Frontier Communications after he claims it breached its contract with him and attempted to collect debt from him that he did not owe.

In the winter of 2015, Sims entered into a service contract with Frontier for internet and telephone service and the recurring monthly charge for the first 12 months of service pursuant to the contract was $29.99, according to a complaint filed in Ohio Circuit Court.

Sims claims the billing he received was incorrect and inaccurate from the outset and that he paid $29.99 each month and attached a letter with the payment explaining that the bill was incorrect and inaccurate and requested a proper adjustment to the bill.

Despite his numerous times to resolve the billing errors, Frontier declined to address the matter and continued to send inaccurate and incorrect bills, according to the suit.

Sims claims later in 2015, Frontier began adding unauthorized charges to the bill and began sending monthly “notice of account past due” to him.

Frontier ultimately disconnected Sims’ service for failing to pay amounts it claimed were due for the unauthorized charges, according to the suit.

Sims claims Frontier also reported him to a credit collection agency which has attempted to collect the unauthorized charges and has severely damaged his credit scores by reporting his account by delinquent.

The plaintiff discovered Frontier’s conduct when he was forced to delay refinancing his home, thereby causing him monetary loss and lost opportunity costs, according to the suit.

Sims claims Frontier continues to attempt to collect the amounts that were not fairly due and owing under the contract.

Frontier engaged in unfair debt collection, which violates the West Virginia Consumer Credit and Protection Act, according to the suit.

Sims claims Frontier has breached its contract with him and acted in bad faith.

Sims is seeking compensatory damages with pre- and post-judgment interest. He is representing himself.
