Estate administrator alleges AFLAC insurance breached contract

NEW CUMBERLAND — A Hancock County man is suing AFLCA insurance, alleging breach of insurance contract in failing to pay benefits following the death of a family member.

David L. Chafin, administrator of the estate of Robert Brian Chafin, deceased filed a lawsuit Dec. 6 in Hancock Circuit Court against American Family Life Assurance Company (AFLAC) of Columbus alleging, failure to perform its contractual obligations.

According to the complaint, on Dec. 18, 2014, Robert Chafin lost his life in a vehicular accident. On Oct. 16, 2015, David Chafin received a check for $25,000 for the death benefit. On Oct. 27, 2015, and Aug. 26, 2016, a letter was provided AFLAC requesting why the estate was provided with only $25,000 instead of $100,000. 

The plaintiff alleges AFLAC of Columbus failed to respond to Chafin's request and failed to provide the full benefit of $100,000 as stated in the policy.

David Chafin seeks trial by jury, compensation for damages, attorney fees, court costs, interest and all other just relief. He is represented by attorney Lawrence L. Manypenny of New Cumberland.
