Weirton building owner claims Jackson-Barrett Deli owes unpaid rent

NEW CUMBERLAND — A commercial building owner in Weirton is suing Jackson-Barrett Deli, LLC and Douglas Jackson, tenant and guarantor, citing alleged breach of the lease agreement.

Barone Realty Service Co. filed a complaint on Jan. 13 in the Hancock Circuit Court against the defendants, alleging that they failed to fulfill their contractual obligations.

According to the complaint, Barone Realty Service alleges it has suffered damages in the form of unpaid rent, fees and taxes for a total of $16,878.56, as well as damage and decreased property. The company holds Jackson-Barrett and Jackson responsible because they allegedly failed to make payments and to compensate the plaintiff for the cost to restore the property.

Barone Realty Service requests a trial by jury and seeks judgment against the defendants for the amount of $16,878.56, pre- and post-judgment interest and other compensatory damages. It is represented by Michael Edward of Sellitti, Nogay & McCune PLLC in Weirton.
