HUNTINGTON — A West Virginia woman is suing a debt collector, alleging invasion of privacy and violation of telephone harassment statutes.
Carla Erwin filed a lawsuit Jan. 17 in Cabell Circuit Court against One Main Financial alleging violation of the West Virginia Consumer Credit and Protection Act.
According to the complaint, after Erwin became in arrears upon an alleged debt, she began to receive collection calls from One Main Financial, attempting to collect the indebtedness. As a result of the defendant's actions, the suit says, Erwin has been annoyed, harassed, bothered, upset and angered.
The plaintiff alleges One Main Financial engaged in unreasonable or oppressive conduct in attempting to collect the alleged debt by continuing to call the plaintiff's phone even after she requested One Main to stop calling her and that she was being represented by an attorney.
Erwin seeks trial by jury, actual and punitive damages, costs of litigation and all other proper relief. She is represented by attorney Daniel K. Armstrong of Klein & Sheridan LC in Hurricane.
