Insurance Commissioner claims employers didn't maintain workers' comp coverage

CHARLESTON — West Virginia Offices of the Insurance Commissioner is suing Assessments Inc. and Sunny Bell, citing alleged violation of state laws.

The Offices of the Insurance Commissioner filed a complaint Jan. 17 in Kanawha Circuit Court against the defendants alleging they violated workers laws.

According to the complaint, the plaintiff alleges that as a result of defendants' conduct, the plaintiff, other employers, claimants served by the defendant and taxpayers continue to suffer irreparable harm. The plaintiff holds Assessments and Sunny Bell responsible because they allegedly failed to obtain and maintain coverage for workers' compensation insurance coverage.

The plaintiff requests a trial by jury and seeks an order enjoining defendants from doing business in West Virginia until all fines and penalties are satisfied and enjoining them from selling or transferring any property belonging to either of them. It is represented by David Ansell of West Virginia Offices of the Insurance Commissioner Legal Services Division in Charleston.
