HUNTINGTON — A Marion County sign language interpreter is suing Huntington hospital operators, alleging breach of a master agreement.
James E. Phillips II of Fairmont filed a complaint Jan. 23 in Cabell Circuit Court against The Mildred Mitchell-Bateman Hospital Auxiliary Inc., alleging the hospital operators did not keep its promise to the plaintiff.
According to the complaint, in anticipation of performing his obligations with the defendant under their April 6, 2016, contract, Phillips has foregone other employment opportunities. As a result of the defendant's breach, the suit says, Phillips has suffered and will continue to suffer loss of substantial income.
The plaintiff alleges the defendant failed and refused to fulfill its obligations under the agreement.
Phillips seeks trial by jury, compensatory damages, lost wages, attorney fees and court costs, together with interest and all other appropriate relief. He is represented by attorney Richard W. Walters of Sheffer & Shaffer PLLC in Charleston.
