MORGANTOWN — A Pennsylvania couple is suing West Virginia University medical care providers, alleging their negligence led to injuries to the wife.
Terri Ann Wiles and Terry Wiles of Fayette County, filed a complaint Jan. 19 in Monongalia Circuit Court against the West Virginia University Board of Governors, West Virginia University Medical Corp., West Virginia University Hospitals Inc., and Dr. John France, alleging they breached their duty to exercise the degree of care, skill and learning required of a prudent health care provider.
According to the complaint, on May 20, 2015, Terri Ann Wiles underwent kyphoplasty surgery at her sixth through eighth thoracic vertebrae to address osteoporotic compression fractures at the defendant's Ruby Memorial Hospital. As a result of defendants' negligence, the suit says, she has suffered physical and mental pain, loss of earning capacity and medical expenses.
The lawsuit states Terry Wiles suffered loss of service, society and consortium if his spouse. The plaintiffs allege the defendants negligently deviated from the standards of medical care by placing the trocars in the wrong locations during surgery and by failing to properly introduce and monitor the cement used during Terri Ann Wiles' kyphoplasty.
The Wileses seek trial by jury, judgment greater than the court's minimum jurisdictional limits, pre- and post-judgment interest, litigation costs and all other appropriate relief.
