Tractor trailer operator blames transportation company for crash

NEW MARTINSVILLE — A Pennsylvania tractor trailer operator is suing a transportation company, alleging the defendant's negligence caused a crash that injured the plaintiff. 

Michael D. Nelson of Indiana County, Pennsylvania, filed a complaint Jan. 25 in Wetzel Circuit Court against Barnhart Transportation LLC of Erie, Pennsylvania, alleging the defendant's driver failed operate the vehicle in a manner to avoid a crash.

According to the complaint, on Feb. 16, 2015, Nelson he was lawfully and carefully operating a tractor trailer on North Fork Road in Wetzel County. Suddenly and without warning, the suit says, the Barnhardt vehicle crossed into Nelson's lane of travel and hit the plaintiff's vehicle. 

As a result of the accident, Nelson sustained severe injuries to his wrist and back, resulting in great pain and mental anguish, medical expenses and loss of enjoyment of life. The plaintiff alleges the defendant's driver failed to keep proper control of the vehicle, failed to sound the horn and warn nearby motorist, and failed to operate the vehicle at a safe speed.

Nelson seeks trial by jury, judgment in excess of the jurisdictional limits of the court, together with court costs, interest and all other equitable relief. He is represented by attorney Thomas D. Hall of Pittsburgh.
