Daughter blames nursing home operators for mother's death

Medical malpractice 09

CHARLESTON — A Kanawha County woman is suing Dunbar nursing home operators, alleging their negligence led to the death of her mother.

Robin Bradley, as personal representative of the estate of Patsy Garnette, filed a complaint Jan. 23 in Kanawha Circuit Court against Sunbridge Dunbar Healthcare LLC, doing business as Dunbar Center and Genesis Healthcare LLC, alleging wrongful death in breaching their duty to uphold Garnette's resident's rights.

According to the complaint, beginning May 24, 2014, Garnette became a resident at the Dunbar Center nursing facility. As a result of the defendants' negligence, the suit says, she sustained significant injuries that ultimately led to her death Nov. 17, 2016.

The lawsuit states Bradley suffered mental pain and loss of companionship of her mother. The plaintiff alleges the defendants failed to provide adequate and appropriate health care and protective services to Garnette and failed to provide an environment free of accident hazards.

Bradley seeks trial by jury, compensatory and punitive damages and all other equitable relief. She is represented by attorneys Andrew L. Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston.
