MOUNDSVILLE — A Glen Dale hospital is suing co-trustees and interested parties, alleging breach of fiduciary duty.
Reynolds Memorial Hospital Inc. filed a complaint Jan. 26 in Marshall Circuit Court against Larry A. Carpenter, Security National Trust, et al, alleging they wrongfully determined the plaintiff was no longer operating as a not-for-profit hospital.
According to the complaint, in July and August 2016, Reynolds Memorial did not receive its monthly income distribution from the Hamlin Trust. As a result, the suit says, the hospital suffered monetary losses. The plaintiff alleges the Hamlin trust officer stopped the July and August 2016 distribution to the hospital without any communications and wrongfully withheld the income distributions to which plaintiff is entitled.
Reynolds Memorial Hospital seeks trial, an order declaring that the plaintiff remains an independently operated not-for-profit hospital, damages for economic losses, interest attorney fees and costs. It is represented by attorney Frank H. Duff of Schrader, Byrd & Companion PLLC in Wheeling.
