CHARLESTON — A former police officer is suing the West Virginia State Police, alleging wage payment violation.
Steven Demaske filed a complaint Jan. 27 in Kanawha Circuit Court against West Virginia State Police, alleging violation of the Wage Payment and Collection Act.
According to the complaint, Demaske was employed by the state police from 2008 to June 6, 2016. At the time of his termination he had accumulated 445.6 hours of leave and was owed $9,626.74, the suit says.
Demaske says he has suffered financial distress for not receiving his final payment on the next pay period as required by law. The plaintiff alleges the defendant failed to pay his final wages June 30, 2016, and now owe liquidated damages, including interest and attorney fees of $19,253.48.
Demaske seeks trial by jury, judgment for damages as allowed by law, court costs and expenses, plus all other just and proper relief. He is represented by attorney Michael J. Del Giudice of Ciccarello, Del Giudice & Lafon in Charleston.
