Raleigh County parents blame multiple defendants for crash

BECKLEY — Two Raleigh County parents are suing multiple defendants, alleging their negligence led to a vehicle crash that injured their child. 

Peyton Walker, an infant, by Shane Walker and Chelsea Walker, her natural parents and guardians filed a complaint Feb. 2 in Raleigh Circuit Court against Quality Distributions Inc., QC Energy Resources Inc., Robert Smith, et al, alleging they negligently entrusted their vehicle to a careless driver.

According to the complaint, on Dec. 15, 2015, the vehicle occupied by the infant Peyton Walker was struck by a vehicle being driven by Smith in MacArthur, West Virginia. Walker sustained injuries that resulted in physical and mental pain, disfigurement and loss of enjoyment of life. The suit says the plaintiffs incurred substantial medical expenses and have been deprived of the consortium. society and comfort of their daughter. 

The plaintiffs allege Smith recklessly failed to stop at the red signal light, failed to maintain careful lookout and failed to maintain proper speed for the conditions.

The Walkers seek trial by jury, judgment, jointly and severally, for compensatory, general and punitive damages, attorney fees and court costs, pre- and post-judgment interest and all other equitable relief.
