Beckley couple blames medical care providers for husband's injuries

Medical malpractice 02

BECKLEY — A Beckley couple is suing Raleigh County health care providers, alleging gross negligence in the treatment of the husband.

Marshall and Susan Jenkins filed a complaint Feb. 17 in Raleigh Circuit Court against Dr. Ali Suleiman, Ali Suleiman MD Inc. and Fresenius Medical Care Appalachian Dialysis, alleging that they recklessly disregarded the safety of Marshall Jenkins.

According to the complaint, sometime after receiving medical care and treatment from the defendants, Marshall Jenkins was diagnosed with severe and permanent damage to his inner ear due to ototoxicity given by defendants. As a result, the suit says, he will continue to suffer physical and mental pain, lost wages and medical expenses.

The plaintiffs allege the defendants failed to obtain express permission of a physician prior to and/or during treatment, failed to ensure that a pharmacist was monitoring during therapy and failed to cease all antibiotics after Jenkins' infection had cleared.

Marshall and Susan Jenkins seek trial by jury, compensatory and punitive damages, together with pre- and post-judgment interest and costs of suit. They are represented by attorney James B. Lees Jr. of Hunt & Lees LLC in Charleston.
