WHEELING — A Marshall County resident is suing his former employer and plan administrators, citing alleged violation of workers compensation acts.
John Leonard filed a complaint on Feb. 22 in the U.S. District Court for the Northern District of West Virginia against JP Morgan Chase Bank NA Long Term Disability Plan, Prudential Insurance Co. of America and Does 1-5, alleging that they violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that on Aug. 26, 2015, his long term disability benefits were terminated by the defendants after he received benefits for over three years. As a result, he has sustained damages and will incur attorney's fees and costs. The plaintiff holds the defendants responsible because they allegedly repeatedly denied his appeal for the additional benefits under the long term disability plan..
The plaintiff seeks an order for the defendants to pay all og his benefits due under the plan, interest, attorney's fees, costs and such other legal and equitable relief. He is represented by J. Patrick L. Stephens of Underwood Law Offices in Huntington.
