Patient blames orthopedic surgeon for injuries

Medical malpractice 03

BECKLEY — A Raleigh County woman is suing an orthopedic surgeon, alleging his medical negligence led to injuries.

Susan Blake Cole of Mount Hope filed a complaint Feb. 24 in Raleigh Circuit Court against Dr. John Tabit, alleging medical negligence in deviating from the standards of orthopedic care and skill.

According to the complaint, as a result of Tabit's deviation, Cole, who had fallen on the ice, sustained a malunion of distal radius with approximately 30 degrees of dorsal angulation, causing her to suffer physical and mental pain, anxiety and depression and medical bills of approximately $120,000.

The plaintiff alleges Tabit failed to properly position and set her distal radial fracture in the appropriate position.

Cole seeks trial by jury, judgment in such amount that will fairly compensate her for damages, plus interest and costs of court. She is represented by attorney Michael F. Gibson of Gibson, Leffer & Associates in Princeton.
